- The Inter-American Court of Human Rights has ordered the Peruvian state to guarantee the legal defense of victims in the case of the Mashco Piro Indigenous people, and to protect FENAMAD and EarthRights International from potential sanctions under the APCI Law (also known as the Anti-NGO Law).
Lima, Peru, July 9, 2025. — The Inter-American Court of Human Rights has issued a resolution ordering the Peruvian state to guarantee that the Native Federation of the Madre de Dios River and its Tributaries (FENAMAD) and EarthRights International can freely carry out their legal defense work in the case concerning the Mashco Piro Indigenous people, who live in voluntary isolation, against the Peruvian state.
The Inter-American Court determined that this case must not be subject to restrictions or sanctions under Law No. 32301, known as the APCI Law, which imposes fines of up to $700,000 USD on organizations that fund, advise, or assist legal actions brought against the Peruvian state.
The resolution reaffirms the obligation of the state to protect the defense of human rights and to ensure that the legal representatives of the victims “can freely exercise their legal representation before the Inter-American Court at all stages of the international proceedings, without being subjected to any form of reprisal for doing so.”
The case was admitted by the Inter-American Commission on Human Rights in 2022, which found that the Peruvian state had violated the human rights of the Mashco Piro people by failing to effectively protect them from extractive activities and the presence of third parties in their territory. In 2024, the case was referred to the Inter-American Court.
Alfredo Vargas, President of FENAMAD, which has spent more than three decades denouncing the threats faced by the Mashco Piro people, emphasized that “this measure represents a decisive step in the defense of the rights of Indigenous people in voluntary isolation. For the Indigenous communities of the Amazon, it means their voices are being heard and they are starting to receive the respect they deserve.”
“The Inter-American Court’s unanimous decision acknowledges the serious threat the APCI Law poses to human rights organizations and, more critically, to victims of grave human rights violations who are seeking justice,” said Juliana Bravo Valencia, Director of the Latin America Office at EarthRights International.
“We hope the state will comply with its international obligations and the Inter-American Court’s order, to allow us to fully carry out our role as legal representatives in this case. This is a historic opportunity to set a precedent that safeguards the physical and cultural survival of Indigenous people in isolation.”
The Inter-American Court’s decision was formally communicated on July 8, 2025 in response to the request for provisional measures submitted by FENAMAD and EarthRights International, the date on which their legal team submitted the brief of requests, arguments, and evidence (BPME) to the Inter-American Court so that the case can continue moving forward in this jurisdiction.
Since 2016, EarthRights has supported FENAMAD in providing legal defense for Indigenous people in voluntary isolation in Peru. FENAMAD and EarthRights serve as legal representatives of the plaintiffs before the Inter-American Human Rights system in the case involving the Mashco Piro, Yora, and Amahuaca Indigenous people versus the Peruvian state, as well as in Precautionary Measure No. 262-05, which remains in force and seeks to protect the Mashco Piro from threats caused by extractive activities and the presence of third parties in their territory.
