Washington D.C., May 1, 2025 – A new policy brief, “Kachin, a Sacrifice Zone for the Green Transition,” brings to light the environmental destruction and human rights violations resulting from the mining of heavy rare earth elements (HREE) in Kachin State, northern Myanmar.
Approximately 60% of two key HREE, dysprosium and terbium, come from mining activities in Kachin, and these elements are primarily used to produce NdFeB magnets for electric vehicles (EV) and wind turbines.
Mining of HREE has drastically increased in Kachin since 2021, as demand for green energy has accelerated around the world. The quantity of HREE mining in Kachin means that it is almost impossible to find an NdFeB magnet free from Kachin-sourced HREE.
The policy brief documents the increasing unchecked destruction that the green energy industry is driving in Kachin State, a biodiverse area home to Indigenous communities and ethnic minorities.
Mining in Kachin is leaving creeks and rivers dangerously contaminated with heavy metals and radioactive elements. Testing carried out by EarthRights International and Kachin civil society in collaboration with academics at Naresuan University, Thailand, showed that leachate from a mining site out of use for 10 years continued to emit toxic heavy metals such as arsenic and cadmium far above safe levels for human exposure.
The brief also highlights that corporations have continued sourcing magnets containing HREE, while knowing that the majority of global supply is being mined in Kachin using extremely harmful practices and then comingled in supply chains.
“Multinational corporations responsible for global demand for these magnets are inextricably linked to dozens of leaching pools at mining sites across Kachin,” said Ben Hardman, the Mekong legal director for EarthRights International. “Corporations should be consulting with Kachin civil society groups and local governance actors on how to help remedy the environmental disaster they’ve helped to create.”
Key recommendations are directed to corporations and governance actors to improve engagement with affected communities in Kachin to mitigate harms and provide appropriate remedies for damage from HREE mining activities:
- Companies with Myanmar HREE in their supply chains should assess current human rights and environmental impacts of HREE mining in Kachin and their leverage to mitigate these impacts.
- Companies that consistently have Myanmar HREE in their supply chains should recognize their likely contributions to human rights abuses and environmental destruction and should work with civil society actors to remedy these contributions.
- The Kachin Independence Organization (which has had effective control of all HREE mining sites in Kachin State since late 2024) should halt HREE mining until it can establish the extent of the harms caused and put in place safeguards in line with international standards in place.
- Governments should enact and enforce human rights and environmental due diligence legislation, prioritizing substantive outcomes for those impacted by risky activities such as HREE mining.
